Franciscan Missionaries of Our Lady University (“FranU,” “we,” “our” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain and protect personal information when you visit or interact with FranU websites and online services that link to this Policy (collectively, the “Website”). This Policy provides transparency about our Website practices and does not create contractual rights or obligations beyond those imposed by applicable law.

Scope

This Policy applies to personal information collected through the publicly available Website, including FranU-configured forms, embedded forms and integrations that link to or reference this Policy. It does not govern authenticated student, applicant, employee, financial aid, clinical or other restricted systems unless expressly incorporated there. Those systems and records may be subject to separate notices, agreements and laws, including the Family Educational Rights and Privacy Act (FERPA) and, where applicable, health privacy laws.

Personal Information We Collect

“Personal information” means information that identifies, relates to, describes or could reasonably be linked with an individual. The Website generally collects personal information when you choose to provide it through inquiry, admissions, event, registration, donation and other forms. Modern Campus CMS does not collect personal information by default; collection occurs through FranU-configured features and integrations.

  • Contact and identifying information, such as name, email address, telephone number, mailing address, date of birth and student identification number.
  • Admissions and educational information, such as educational background, entry term, student type, intended major or program of interest and optional employment information.
  • Communications and preference information, such as inquiry content, email preferences and SMS opt-in status.
  • Donation and transaction information, such as donor contact information, billing address, payment information, donation amount and related transaction details collected through GiveSmart and its payment processors.
  • Technical and usage information, such as IP address, approximate location, device and browser information, pages visited, time on site, referral and campaign information, Website interactions, advertising engagement, conversion events and inferred interests or audience segments.

Some of the information identified above, including date of birth and payment information, may be considered sensitive data under certain laws. FranU does not intentionally collect sensitive personal information through general Website browsing or standard inquiry forms. If required under applicable law, FranU will collect and process sensitive personal data only with your consent. Financial aid information, protected student information and other sensitive information may be collected through secure, authenticated systems used for application, enrollment, financial aid or other institutional processes. If you choose not to provide or allow us to collect some information, we may not be able to provide you with requested features, services or information. Please provide sensitive information only through a channel FranU designates for that purpose.

How We Collect Personal Information

FranU may collect personal information directly from you; through embedded forms and institutional systems, including Technolutions Slate; through fundraising and payment platforms, including GiveSmart; automatically through cookies, pixels, tags, and similar technologies; and from service providers, advertising and analytics partners, and other third parties that support the Website or FranU operations. Tracking associated with Slate CRM may in some circumstances be linked to an identifiable individual or user record when the individual previously provided information through FranU systems.

How We Use Personal Information

FranU may use personal information to respond to inquiries; provide requested information; support prospective students and applicants through admissions and enrollment; communicate by email or, where you have provided consent, by SMS; process donations, payments and related transactions; and maintain donation and supporter-engagement records.

FranU may also use personal information to personalize Website content; operate, maintain, improve, measure, secure and troubleshoot the Website and related systems; analyze marketing effectiveness, recruitment efforts, Website use and campaign performance; support enrollment management, institutional advancement and other University operations; comply with legal, contractual and reporting requirements; investigate suspected misconduct; establish, exercise or defend legal rights; fulfill any other purpose for which you provide the information or that is described to you at collection; and for any other purpose with your consent.

Cookies and Similar Technologies

The Website uses cookies, pixels, tags and similar technologies for analytics, Website administration, attribution, personalization, audience segmentation, advertising, retargeting and conversion measurement. Providers may include Google Analytics 4, Google Tag Manager, Meta Pixel, LinkedIn Insight Tag, TikTok Pixel, Snap Pixel, Google Campaign Manager 360, The Trade Desk, Viant Technology, TVScientific, iPredictive and Carnegie Clarity, which uses BlueConic.

Information collected through these technologies may be associated with an identifiable person or user record. Some third parties may use cookies or non-cookie technologies under their own terms and privacy policies. Browser settings that block cookies may not prevent all forms of tracking.

FranU may change the technologies and providers used on the Website as its operations evolve. Additional integrations, embedded forms, social-media links and service providers may be present.

These technologies help FranU understand Website use, evaluate outreach, improve functionality, personalize experiences and support recruitment and advancement activities.

How We Disclose Personal Information

FranU may disclose personal information as reasonably necessary to authorized personnel and affiliates; admissions and CRM providers, including Technolutions Slate; Website, hosting, content-management, and academic-catalog providers, including Modern Campus CMS and SmartCatalog; fundraising and payment providers, including GiveSmart; and marketing agencies, print vendors, communications providers, advertising platforms, analytics providers and attribution or personalization providers. FranU’s admissions, hosting, academic-catalog, fundraising and payment providers operate under contractual agreements with FranU that require them to keep personal information confidential and to use it only for the purposes for which FranU discloses it to them. Advertising and analytics platforms may collect and process information in accordance with their own terms and privacy policies.

Sale, Sharing and Targeted Advertising

FranU does not sell personal information for monetary consideration and has not sold personal information in the preceding 12 months. FranU may share personal information with advertising and analytics partners for cross-context behavioral advertising purposes through cookies, pixels and similar technologies. Categories of personal information shared may include technical and usage information such as device identifiers, browsing activity and inferred interests or audience segments. Third parties receiving this information may include advertising platforms, analytics providers and attribution or personalization providers. Some state privacy laws treat disclosures of this kind as a “sale,” “sharing” or targeted advertising. Regardless of whether any such law applies, you may ask FranU to stop sharing your personal information for targeted advertising purposes by contacting FranU as described under Your Choices and Opt-Outs below.

FranU may also disclose personal information to fulfill the purpose for which you provide it; for any other purpose disclosed by us when you provide the information; with your consent; to comply with law or legal process; to respond to governmental requests; to enforce our terms of use and other agreements; to protect rights, property or safety; to investigate wrongdoing; to secure FranU systems; or to support a merger, reorganization, transfer of operations or assets or similar institutional transaction, subject to applicable law.

Aggregated and Deidentified Information

FranU may collect, process and disclose aggregated or deidentified information for any purpose, without restriction. When FranU collects, processes or discloses aggregated or deidentified information, FranU will maintain and use it in deidentified form and will not attempt to reidentify the information, except to determine whether its deidentification processes satisfy applicable legal requirements.

Your Choices and Opt-Outs

You may use FranU’s cookie banner where available and adjust browser or device settings to limit or block cookies, although doing so may affect Website functionality and may not prevent non-cookie technologies. You may unsubscribe from marketing emails through the link in those messages and opt out of SMS messages by following the provided instructions. For interest-based advertising, you may use controls offered by the relevant platform or the Network Advertising Initiative at https://www.networkadvertising.org/choices/. You may also email FranU at marketing@franu.edu to request that FranU stop sharing your personal information for targeted advertising purposes. FranU does not control whether third-party tools recognize or honor your selections.

State Privacy Rights

Comprehensive state consumer privacy laws, including the California Consumer Privacy Act, generally do not apply to FranU as a nonprofit institution of higher education or to information governed by FERPA and other sector-specific laws. If a state consumer privacy law becomes applicable to FranU or to personal information collected through the Website, FranU will provide any additional rights and disclosures required by that law. Individuals with questions about privacy rights that may apply to them may contact FranU using the information under Contact Us below.

Retention and Security

FranU retains personal information for as long as reasonably necessary for the purposes described in this Policy or as otherwise permitted or required by law, considering institutional policies, operational needs, official-record requirements, legal and reporting obligations, dispute resolution, security and fraud prevention. Retention periods vary by information type and context, and admissions, advancement and student information may be retained as part of FranU’s official records. FranU will delete, destroy or deidentify personal information in accordance with its institutional policies and applicable legal requirements.

FranU uses reasonable administrative, technical and physical safeguards designed to protect personal information from accidental loss or destruction and from unauthorized access, use, alteration and disclosure, which may include role-based access controls, secure systems and vetted platforms, encryption where appropriate and contractual data-protection requirements. No website, system or electronic storage is completely secure, and FranU cannot guarantee the security of personal information transmitted to, through or in connection with the Website. In particular, email, texts and chats sent to or from the Website may not be secure, and you should carefully decide what information you send via such channels. Any transmission of personal information is at your own risk.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal information against unauthorized use, disclosure and access.

Children’s Privacy

The Website is not intended for, and FranU does not knowingly collect personal information from, children under the age of 18. If FranU learns that it has collected or received personal information from a child under 18 without verification of parental consent, FranU will delete that information. If you believe FranU may have collected information from a child under 18, please contact FranU using the information below.

Third-Party Services and Other Notices

The Website may link to or integrate with third-party websites, platforms, forms, social-media services and other services. FranU does not control their privacy or security practices, and information provided directly to them is governed by their terms and privacy policies. This Policy does not replace notices or rights applicable to education records under FERPA or information subject to other specialized laws.

FranU will not collect additional categories of personal information or use personal information previously collected for materially different, unrelated or incompatible purposes without providing notice. Where required by applicable law, FranU will also seek consent before using personal information for a new or unrelated purpose.

Changes to This Policy

FranU may update this Policy to reflect changes in practices, technologies, legal requirements, or operations. FranU will notify you of changes to this Policy by updating the “Last Updated” date and posting the updated Policy on the Website. FranU will provide additional notice of material changes when required by law. FranU may email or otherwise communicate reminders about this Policy, but you should check the Website periodically to see the current Policy and any changes.
